SSP is £123.25 per week for 2026/27, or 80% of average weekly earnings where that is lower, paid for up to 28 weeks. Since 6 April 2026 the Employment Rights Act 2025 has removed the three waiting days and the Lower Earnings Limit, so SSP starts on day one for every employee.

Who qualifies for SSP?
All employees. Since 6 April 2026 there is no Lower Earnings Limit and no waiting days, so SSP is payable from the first day of sickness. Low earners get 80% of average weekly earnings rather than the flat rate.
Can I reclaim SSP?
No - since 2014, employers cannot reclaim SSP from HMRC.
Does the ERA 2025 change SSP?
Yes, and it is already law. From 6 April 2026 the three waiting days and the Lower Earnings Limit were removed, so every employee gets SSP from day one.
